The terms outlined in below are effective January 1, 2014. By accessing myCashCow you are agreeing to these terms of use. The terms are designed to ensure myCashCow works for everyone.

By accessing myCashCow, you agree you will not:

  • Violate any laws
  • Violate our Posting Policy
  • Post any material that is deemed to be defamatory, abusive, threatening, obscene or indecent.
  • Infringe any third party rights
  • Be false of misleading
  • Distribute or be a part of any spam, chain letters or pyramid schemes
  • Distribute any viruses or other technologies that may harm myCashCow or myCashCow users
  • Use a robot spider, scraper or other automated means to collect content for any purpose without myCashCow’s explicit permission
  • Harvest information about others, including their email address, without explicit consent
  • Interfere with the proper working of myCashCow
  • Copy, modify or distribute another person’s content without their permission
  • Bypass measures used to restrict or prevent access to myCashCow

The information you submit to myCashCow is solely your responsibility. You are responsible for any consequences resulting from your post/s on myCashCow. We reserve the right to remove or refuse content at our discretion. We also reserve the right to, at our discretion, restrict or delete a user either temporarily or permanently. We also reserve the right to refuse a user’s registration, entirely at our discretion.

Please report any problems, offensive behaviour or content, policy breaches or suspected fraud to us.

Without limiting other solutions, we may issue warnings, limit or cease our service, remove hosted content and take technical and legal steps to keep users off myCashCow if we believe that they are creating problems or not acting within the letter or spirit of our policies. However, whether we decide to take any of these steps, remove hosted content or keep a user off myCashCow or not, we do not accept any liability for monitoring myCashCow or for unauthorised or unlawful content on myCashCow or use of myCashCow  by users.

Fees

myCashCow will sometimes charge a fee for certain services. You are able to review and accept the terms of said fee at the time of posting your ad. Our fees are in Australian dollars and we may change them at our discretion. If we make changes to our fees we will notify you by making changes on the site. myCashCow may also temporarily change our fees for promotional events; these changes apply when we announce said event.

Our fees are non-refundable and it is your sole responsibility to pay them when they are due. If you do not pay your fees we may limit your ability to use our services. If when paying your fees your payment method fails or the fees are past due, we may collect the fees owed to us by other means.

Content

myCashCow has content created by us, by you and by other users. myCashCow is protected by copright laws and the applicable international treaties.

Content displayed on or via myCashCow  is protected as a collective work and/or compilation, pursuant to copyrights laws and international conventions. You agree not to copy, distribute or modify content from myCashCow  without our express written consent. You may not disassemble or decompile, reverse engineer or otherwise attempt to discover any source code contained in myCashCow . Without limiting the foregoing, you agree not to reproduce, copy, sell, resell, or exploit for any purposes any aspect of myCashCow  (other than your own content). When you give us content, you are granting us and representing that you have the right to grant us, a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub-licensable right to exercise the copyright, publicity, and database rights to that content.

Infringement

It is your responsibility to avoid posting content that infringes upon the rights of any third parties. This includes, but is not limited to, content that infringes on intellectual property rights (including copyright or trademark). Entitled parties (e.g. owners of copyright or trademarks) can report any offers that they believe infringe on their rights. If the legal representative of the entitled party reports this to us in the correct manner, we will remove the offer infringing on the intellectual property rights.

If you believe that a listing on myCashCow is infringing on your intellectual property, please download the Notice of Infringement form. Once the form is filled out please fax it to myCashCow. We will then confirm your enrollment in myCashCow’s Verified Rights Owners (VeRO) program. Once you have been enrolled in the program myCashCow will send you instructions on how to submit future reports electronically.

Please note that only lawful owners of the intellectual property may use this form.

Liability. Nothing in these terms shall limit our liability for fraudulent misrepresentation, for death or personal injury resulting from our negligence or the negligence of our agents or employees. You agree not to hold us responsible for things other users post or do.

We do not review users’ postings and are not involved in the actual transactions between users. As most of the content on myCashCow  comes from other users, we do not guarantee the accuracy of postings or user communications or the quality, safety, or legality of what’s offered.

In no event do we accept liability of any description for the posting of any unlawful, threatening, abusive, defamatory, obscene or indecent information, or material of any kind which violates or infringes upon the rights of any other person, including without limitation any transmissions constituting or encouraging conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any applicable law.

We cannot guarantee continuous, error-free or secure access to our services or that defects in the service will be corrected. While we will use reasonable efforts to maintain an uninterrupted service, we cannot guarantee this and we do not give any promises or warranties (whether express or implied) about the availability of our services.

Accordingly, to the extent legally permitted we expressly disclaim all warranties, representations and conditions, express or implied, including those of quality, merchantability, merchantable quality, durability, fitness for a particular purpose and those arising by statute. We are not liable for any loss, whether of money (including profit), goodwill, or reputation, or any special, indirect, or consequential damages arising out of your use of myCashCow , even if you advise us or we could reasonably foresee the possibility of any such damage occurring. Some jurisdictions do not allow the disclaimer of warranties or exclusion of damages, so such disclaimers and exclusions may not apply to you.

Despite the previous paragraph, if we are found to be liable, our liability to you or any third party (whether in contract, tort, negligence, strict liability in tort, by statute or otherwise) is limited to the greater of (a) the total  fees you pay to us in the 12 months prior to the action giving rise to liability, and (b) 100 Pounds Sterling.

Personal Information. By using myCashCow , you agree to the collection, transfer, storage and use of your personal information by myCashCow on servers located in the Australia and United States as further described in our Privacy Policy. You also agree to receive marketing communications from us unless you tell us that you prefer not receive such communications.

Resolution of disputes

If a dispute arises between you and myCashCow , we strongly encourage you to first contact us directly to seek a resolution by going to the  myCashCow  Help page. We will consider reasonable requests to resolve the dispute through alternative dispute resolution procedures, such as mediation or arbitration, as alternatives to litigation.

General. These terms and the other policies posted on myCashCow  constitute the entire agreement between myCashCow  and you, superseding any prior agreements.
